The lawsuit, filed in Alameda County Superior Court addressed LBNL's regulatory request that it be permitted both to increase its hazardous and mixed waste storage capacity at their "new" waste facility and to expand on-site waste treatment. The Berkeley community lawsuit called for the Lab to undertake a supplemental Environmental Impact Report (EIR) and that the court place a stay order on the proposed permit modification unless an EIR was issued. The judge dismissed the community lawsuit several day after this press conference.
